Saratoga County Democratic Committee Chair calls for Investigations and Resignation of Court Attorney Brett Eby.

Martha Devaney highlighted multiple instances of concern related to ethical issues for the Republican Candidate for District Attorney 

Wilton, NY – Following revelations into the conduct of Brett Eby, the Republican nominee for Saratoga County District Attorney, the Saratoga County Democratic Committee Chair Martha Devaney released the following statement:

“As chair of the Saratoga County Democratic Committee, I lodged a formal complaint of ethics violations regarding Brett Eby, Republican DA candidate. The complaints were lodged with the NYS Board of Elections, Division of Election Law Enforcement. I also call on the Office of Court Administration to investigate Attorney Eby in his capacity as Principal Court Attorney to Supreme Court Justice Paul Davenport. Attorney Eby is plagued by an ethical cloud and his record is replete with instances of conflicts of interest that must be made public with sanctions issued. The Saratoga County voting public deserves to be apprised of this pattern of misconduct for a candidate running for District Attorney, a position that requires the highest ethical standards. We call for an investigation to be launched and for Eby to resign his current position.” 

Brett Eby, who has been propped up for Saratoga County District Attorney by Republican Party bosses, has a track record of ethically questionable actions and decisions, which violate professional standards and codes.

Eby conducted endorsement interviews for the conservative line for Malta town board seats. This is a serious breach of ethics given the very strict standards for Court Attorneys in the Judicial branch of state government.

In a previous position in Warren County, Eby accepted an appointment as a special prosecutor while also serving as principal law clerk to a Court of Claims Judge. It is a similar situation to the current one in Saratoga County where Eby interviewed party candidates while also serving as a court attorney. It is a glaring conflict of interest for a full-time employee of the judicial branch to accept part-time employment in the executive branch. Such an arrangement is inconsistent with the separation of powers and the oath sworn as an attorney to uphold the constitution.

Eby has repeatedly accepted donations from Bruce Tanski, who pleaded guilty to election interference using accomplices to hide his donations to the campaign of a former supervisor. For more information on the Tanski’s case and current donations to Eby’s campaign:

The most recent contribution is for $3000 on 8/13/25. It is inappropriate that a candidate running for District Attorney, an office which requires high ethical standards, would accept a donation from someone who has been convicted of interfering in previous elections.

Voters deserve to know of this pattern of shady and unethical conduct as the complaints are before the NYS Board of Elections, Election Law Enforcement Division.
